This agreement has been prepared in accordance with the obligation to draw up contracts for sales made over the internet, as required by the Regulation on Procedures and Principles Regarding the Application of Distance Contracts, published in the Official Gazette dated 13.06.2003 and numbered 25137, and is structured as follows:

1 - SUBJECT

The subject of this agreement covers the rights and obligations of the parties, in accordance with the provisions of Law No. 4077 on Consumer Protection and the Regulation on Procedures and Principles for the Application of Distance Contracts, regarding the sale and delivery of the product, whose characteristics and sales price are specified below, sold by the SELLER to the BUYER.

2.1 - SELLER INFORMATION

2.2 - BUYER INFORMATION

The person who registers as a customer on the website www.kohlegear.com. The address and contact information used during registration shall be taken as basis.

3 - PRODUCT INFORMATION SUBJECT TO THE AGREEMENT

The type, quantity, brand/model, color, number, sales price, payment method of the goods/product/service, and other information available at the time the order is finalized.

4 - GENERAL PROVISIONS

4.1 - The BUYER declares that they have read and understood all preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product(s) subject to the agreement specified in Article 3, and that they have provided the necessary confirmation electronically.

4.2 - The product(s) subject to the agreement shall be delivered to the BUYER or to the person/entity at the address indicated by the BUYER within the period specified in the preliminary information, depending on the distance of the BUYER's residence, provided that it does not exceed the statutory 30-day period for each product. This period may be extended by a maximum of 10 days, provided that the BUYER is notified in advance.

4.3 - If the product subject to the agreement is to be delivered to a person/entity other than the BUYER, the SELLER cannot be held responsible if the person/entity to be delivered does not accept the delivery.

4.4 - The SELLER is responsible for delivering the product subject to the agreement sound, complete, in accordance with the specifications stated in the order, and with any warranty certificates and user manuals, if applicable.

4.5 - For the delivery of the product subject to the agreement, it is a condition that a signed copy of this agreement is delivered to the SELLER and the payment has been made by the payment method preferred by the BUYER. If, for any reason, the product price is not paid or is cancelled in the bank records, the SELLER shall be deemed to be released from the obligation to deliver the product.

4.6 - If, after the delivery of the product, the relevant bank or financial institution fails to pay the product price to the SELLER due to the unauthorized or unlawful use of the BUYER's credit card by unauthorized persons, not caused by the BUYER's fault, the BUYER is obliged to return the product to the SELLER within 3 days, provided that it has been delivered to them. In this case, the shipping costs shall be borne by the BUYER.

4.7 - If the SELLER cannot deliver the product subject to the agreement within the due period due to force majeure or extraordinary circumstances preventing transportation, such as adverse weather conditions or disruption of transportation, the SELLER is obliged to inform the BUYER of the situation. In such a case, the BUYER may exercise one of the rights to cancel the order, replace the product subject to the agreement with an equivalent if available, and/or postpone the delivery period until the obstructive situation ceases. If the BUYER cancels the order, the amount paid shall be reimbursed to them in cash and in full within 10 days.

4.8 - Products sold with or without a warranty certificate, which are faulty or defective, can be sent to the SELLER for necessary repair under warranty conditions; in such a case, shipping costs will be covered by the SELLER.

4.9 - This agreement shall become valid after it is signed by the BUYER and delivered to the SELLER via fax or mail.

5 - RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the agreement within seven (7) days from the date of delivery of the product to themselves or to the person/entity at the address indicated. To exercise the right of withdrawal, the BUYER must notify the SELLER via fax, e-mail, or telephone within this period, and the product must not have been used within the framework of the relevant article's provisions. In case this right is exercised, it is obligatory to return the original invoice along with a copy of the cargo delivery receipt indicating that the product delivered to the third party or the BUYER has been sent to the SELLER. The product price shall be refunded to the BUYER within 7 days following the receipt of these documents. If the original invoice is not sent, VAT and other legal obligations, if any, cannot be refunded. The shipping cost for the returned product due to the right of withdrawal shall be borne by the BUYER.

Products that are not suitable for return due to their nature, single-use products, are subject to the condition that the product packaging has not been opened, damaged, and the product has not been used.

Furthermore, the consumer cannot exercise the right of withdrawal for goods produced according to the consumer's special requests and demands, or made personalized by making changes or additions to them.

In the implementation of this agreement, Consumer Arbitration Committees up to the value declared by the Ministry of Industry and Trade, and Consumer Courts in the SELLER's place of residence (Kocaeli/Gölcük) are authorized.

In case the order is finalized, the BUYER shall be deemed to have accepted all the terms of this agreement.

ORDER AND DELIVERY TERMS

When will my order arrive?

For customers shopping on www.kohlegear.com, the accuracy of your order's payment/invoice information must first be approved before your order can proceed to the supply and delivery stage. Under normal circumstances, purchases made from www.kohlegear.com are delivered via cargo within 1-2 business days for addresses within Kocaeli, and within 1-5 business days for all other cities outside Kocaeli.
